HE IS OUT AGAIN!!!
4:25pm: Barely 21 hours after the Kuala Lumpur High Court ruled Datuk Seri Mohammad Nizar Jamaluddin was Perak Menteri Besar, the post is now back to Barisan Nasional's Datuk Seri Dr Zambry Abdul Kadir. The Court of Appeal has allowed a stay of execution of the order pending an appeal filed by Zambry this morning, V. Anbalagan reports. In an immediate response, Zambry overturned the key BN policy reversions declared by Datuk Nizar Jamaluddin earlier this morning, which includes suspensions of the State Secretary and Legal Adviser.
On the topsy-turvy nature of the situation now, Nizar commented: "I will for my legal counsel. When everything is clearer, we will see the consequences to ascertain its level."
However, Nizar admitted that both parties need to stop the impasse in perak.
Pakatan Rakyat officials stressed that the decisions made by Nizar with his exco in an emergency meeting last night is valid, even if it lasted for only a mere 16 hours.
"Everything is back to status quo," he said.
On whether he should called for an emergency State Assembly sitting, Zambry said he will first go through the grounds of the High Court judgment before reaching a decision.
Meanwhile, in his decision today, Court of Appeal judge Datuk Ramly Ali said he was satisfied that there were special circumstances to grant the stay as Zambry's appeal would be rendered nugatory if the stay was not granted, Bernama reports.
The court, he said, would fix an early date to hear Zambry's appeal.
He said
"This is a very unique case as it does not only involve Dr Zambry and Mohammad Nizar but also the entire Perak state," he said.
Yesterday, High Court judge Abdul Aziz Abdul Rahim declared Nizar as the rightful menteri besar after ruling that he (Nizar) had not vacated the office of menteri besar since he had not lost the majority confidence of the state legislative assembly.
On Feb 13, Mohammad Nizar, 52, filed an application to the court for a declaration that he is at all material times the rightful menteri besar of Perak and an injunction to bar Dr Zambry from discharging his duties as the menteri besar.
Mohammad Nizar, who was appointed menteri besar on March 17 last year after the DAP-PKR-PAS alliance won 31 seats in the 12th general election, also sought a declaration that Dr Zambry has no right to hold the office of menteri besar.
Both sides have 28 seats each in the 59-seat assembly after three Pakatan assemblymen quit their parties to become independents and the fourth jumped back from PKR to Umno.
Sultan Azlan Shah then asked Nizar to step down as menteri besar and swore in Dr Zambry after declaring that Barisan Nasional had the majority in the state legislative assembly.
Zambry filed the stay application and notice of appeal 16 hours after Mohammad Nizar returned to office.
Following today's decision, one of Nizar's counsel, Ranjit Singh, said they are contemplating filing an appeal to the Court of Appeal to set aside the stay order.

THE REAL MB IS BACK!!!
6:24pm: The High Court today declared Datuk Nizar Jamaluddin as the legitimate Menteri Besar of Perak and his bid to regain office will come sooner than expected after the same court denied the application of rival MB, Datuk Dr Zambry Abdul Kadir, for a apply for a stay pending an appeal.
Court said the fatal Barisan Nasional mistake was despite the majority of 31 against 28, the coalition failed to take a no-confidence vote against Nizar in the state assembly.
The Judge said once appointed as chief executive of the state, the Menteri Besar is only answerable to the state assembly.
The judge also said the job of the Ruler or head of state was only to appoint a Menteri Besar and if he refuses to resign, he cannot be sacked or his position vacated.
